Yes I am completely aware of what those items mean, the question is do you?
Sig advertised quite extensively that you could purchase a Sig 250 and then purchase a quick change kit at the fraction of the cost, keep the same serial number, and get a different size or caliber firearm. There was never a mention that these were not available. Two years down the line they then stated they would only be selling whole guns because it was more lucrative to do so. This is where the bait and switch comes in.
With that in mind it is a common expectation to be able to get additional mags when purchasing a firearm. In this case you have to purchase another gun to get the mags or in many cases it is cheaper to purchase the second firearm for the mags than to buy the mags. This is where that comes in.
Go ahead and short change people if you want but if they were a smaller company, like a mom and pop, they would catch a charge. Since you know all about bait and switch you would also know, in Virginia, you can catch a charge just by being an agent of the corporation who fails to provide the item. Yes, venue would be Virginia for anyone who lives here and purchase a Smith product. Even if the charges were dismissed against the employes and Smith there would then be civil issues which requires a much lower burden of proof. The simple advertisement of spare magazines on the site could be enough. On top of that NO .gov purchases would be made while the charges were pending. So you are looking at a very hefty penalty even if they dont win. In order to do any sort of counter suit you would have to prove intent to damage the character of Smith. Since Smith, a corporation seen as a public person, would require malicious intent to win a counter suit; it would be impossible to win any costs back.
Of course you knew all of this with your years law school and knowledge in the field. You would with no doubt be the one defending them and getting to go home every night rather they won or lost with money in your pocket.
I am in now way saying sue smith, I just wish these gun companies would stop trying to profit off a political issue and do what they say they are going to do. I would hate my trigger spring to break tomorrow, go to the site to place an order, get my CC charged, and get an email saying my order will not be honored because they can make more money selling guns so purchase a new gun. It is pretty clear that most of the country will not be getting an additional ban at this point. To deliberately fix supply in order to increase demand is wrong. There is absolutely no reason that one can not get on a 2 week backorder on $25 9mm mags. That is no reason other than greed. Call it socialist or communist or whatever, why should they profit when our rights are under fire.
