Want to know just how crazy I am? I disagree with all gun laws. Scary high-cap magazines for everybody, I say, and full-autos for all. No licenses, no background checks, in all 50 states and the D of C. If the police are allowed to have it, we should be allowed to have it, and acquire it by walking into a gun store with a credit card or cash money. Precisely on the grounds that any half-wit can circumvent them all if they feel like being a criminal sort. Hell, it'd make it easier to track down guns used in crimes--gun stores have cameras, and I don't know of a single hood that's registered his stolen waistband piece.

But I obey all gun laws, because I'm a law-abiding citizen and not a criminal. That's the difference. Criminals do what they want, and we law-abiding folks suck it up and do stuff we don't like to do.

I carry a 45 pistol of some flavor everywhere except Federal facilities and Doctor's offices and I don't like that.

...the law is very clear. If they don't have it posted at EVERY public entrance, you can't be convicted.

Where are you quoting those regs from?
Are you telling me that I can't be prosecuted by taking a concealed handgun onto a a military base because it may not have a sign posted at every entrance?
 
I am not a lawyer. I was a cop. What he is saying is: in order to be CONVICTED you must have been WARNED that it is ILLEGAL to carry in a specific place.

That warning could be verbal, (in a jurisdiction I formerly lived in a property owner had to verbally warn a CCW holder guns were not permitted, therby giving the CCW holder the opportunity to leave, no harm no foul) or it could be a sign. There are usually standards for signage (because nobody would notice if written on a 1 inch by 2 inch sign). and THE SIGNS MUST BE POSTED ON EVERY ENTRANCE (because every person may not have come through the main doors).

That said, I am not sure I would bet my freedom that everybody is going to accept the statute AS WRITTEN IN PLAIN ENGLISH. If there is video footage of you walking through the main entrance and that is the ONLY POSTED entrance an argument might be made that you were constructivly warned. You may win in the end but have to fight a protracted battle to do so.

I belive that the Constitution gives us the right. But I also use my brain to decide which fights are worth fighting.

Not a "reg" it's the law: U.S. Code › Title 18 › Part I › Chapter 44 › § 930

No, you can be prosecuted for anything. And, I'm not telling you anything. I merely quoted the law and pointed out a specific paragraph, (h), where it says you can't be convicted if it's not posted at every public entrance. Two completely different things. I'm not being contrary here. When talking about the law you must be very specific because the courts will be.

Further, we are NOT talking about military installations here. We're talking about federal facilities which are specifically defined in this law as:
(g) As used in this section:
(1) The term "Federal facility" means a building or part thereof owned or leased by the Federal Government, where Federal employees are regularly present for the purpose of performing their official duties.
So, it has to be a building. Also, since this was initially about a Naval Hospital, it matters where that hospital is located. If it's on a base/installation, they have completely different rules.

The military has complete hegemonic control over bases or installations. They can discipline their own people (active duty) and control their own facilities.

This is sound wisdom and we should all take this to heart.

I started this little exercise in federal law to make us think. Just because "uncle Joe" told us something doesn't make it law. Just because it's written in the law doesn't mean the courts will interpret it in our favor.

TomkinsSP makes a good point about the video. If you're seen walking in a door that is marked, but there is another door that isn't, it could be interpreted either way. We've all heard of people getting off on a technicality. This is one such technicality. Will the judge rule in your favor? Who knows?

We must indeed be smart. As he said, you might win your case, but you might also have to fight it from a jail cell. Do you want to do that? Is carrying your gun in whatever location worth the hassle should you be caught? Maybe it is, but sometimes it's not.

The take-away from this is not that you can carry in place X. What we should learn from this is to do our own research. Most are too lazy and are just willing to accept what someone else said. I'm not a lawyer, I don't play one on TV and I didn't stay at a Holiday Inn Express last night. Even if I were a lawyer, I would tell you the same thing; take nothing at face value. Research it and learn your rights. Then apply the common sense we should all have.

For example: in CA it's legal for me to carry a gun into a courtroom if I'm not party to an action pending before the court. Even though it's legal, it's probably not a good idea to even try to carry a gun into a courtroom. AND, do you really need to?


So, carry everywhere it's legal because you never know when you'll need it, but, be smart. There are some places where it's wiser to just take the risk that you won't be attacked.
 
I know this is an older thread but I have posted on it several times. Prayers go out to the victims of the heinous Texas church massacre. Again, the best response to a bad man with a gun is a good man with a gun.
 
Churches are only legal to carry upon permission. There may be more people carrying than what most people think in churches. The church I attend is just outside of a major city whereany other (religion)s are present, so the issue has come to mind often. This world is going sour, not much surprises me anymore. Be smart, be prepared!

Which state are you posting from? What you say is true in a few states, false in many others.
 
The only gun free zones I have to go to is my Doctor and the hospital if I have a test done, and the local post office .. any other business that has the no gun sign I refuse to shop at ..

In the area I live you don't see as many as was first placed at doors when the law was first implemented .. around 17% of the population have permits and shops soon learned that 17% of the customers not coming in would make them soon close their doors ..

Sadly GUN FREE ZONES have become KILLING ZONES !!!!!

Nope none to do with religion by any strech it's all pure evil. My Nephew by marriage is the Pastor of the Church where we moved from Central Florida . A medium size Church . My volunteer job was help in information booth at rear of church. But my biggest mission was to run security ( armed concealed) always. That booth gave me a line if sight from the pulpit platforms to all the exit doors. My Nephew knew. We where on always. Most of the Members knew me very few of the chossen ones knew we where carrying. If I had it my way no who would have know. Other than the other security staff. I pray the staff is still on it. We had a prision minstery . the one that picked up the prisoners was ex marine. We had one try and escape one time. Very few church members had a clue what was happing. Pastor kind of chuckled as our team had to go out side doors to retrieve him
