Got DENIED purchase of a gun today, anyone else had this happen and appeal?

Me, I'd go back and get them to run it through again.
Or just get your wife to buy it for you-that's what my clients do :D

In the past on a delay I've asked that it be rerun and like magic it was approved. I was denied once but NICS caught the error.

It is not a straw buy if ones spouse buys a gun as a gift for a family member and knows they legally can own firearms.

Also for you and all other folks, I refuse to buy from shops that use the automated computer forms. This is sent in and goes in queue. It is worked at their leisure. It eventually gets to the FBI approval point and I can guarantee it will take the full 3 day or longer time frame. For the folks who do not have splosive training or a felon with the same name it seems to be ok.

Dicks had the best price on Ruger 10-22's last spring. And one could buy a 1400 round Remington bucket of 22 ammo for $59.00 with the purchase of a 22. I bought me one, 4 day wait.

By law if they do not get back to you in 3 days you can go ahead with the sale. It seems most do not want to do this now, esp the big box shops. 4 or 5 days later Dicks called and said it is a proceed. Well thanks for not calling and checking.

Shortly thereafter My oldest grandson graduated from HS. We were going to go down for his grad party, a 5 hour trip. My wife wanted to give him money, I said nope he has a job and if we give him money it will be spent on games or some short term toy and he'll never remember it. He needs a good 22.

On the way out of town we went to the same store and she bought it as a gift for the GS. The auto form is slow, it is triple checked by upper management and after they walked it to the car we were off. My wife did say too darn long we won't buy gifts there again.

Gator, some of us do get delayed and have the wait. You are not alone. I have had security clearance, I was in the US Army reserves and I was a reserve Deputy for about 8 years. I should be OK.

I personally think if you have been approved in the past and if nothing has changed it was an error. I think I would ask the shop to drop the sale after 3 days and start over from square one.

You can beat the long denial process wait by going and getting your WY CCW or CHP.

And yes embarrassment happens on the 1st time. The odd thing is, I bought firearms for some time after the NICS started, no problems, then one day I was delayed at a shop where I did most of my business.

I don't like NICS at all. It is an artifact of the libtard illusion that there is a way in a country with 150,000,000 guns to keep an adult who is not locked up from getting one. It's just a bunch of happy horse$#|+.

Yes, that is why my wife & I obtained our permits. We drive into Montana semi-frequently, where a permit is required. And I know that many Sheridan folks drive to Billings for supplies etc. Wyoming is a "shall issue" state, and the process is pretty easy.

My wife was delayed once. She is a resident alien and had only purchased long guns before. She got delayed on a handgun. The sad part was that she wanted me to do the check in my name, and I told her she would be fine since she'd bought a rifle and a shotgun in the past with no issues. I should have listened, but well, I'm a man and we don't do that well. The store called the next day and told her she was good to go. I think it probably had something to do with being a non-citizen.
 
I was actually denied, not delayed. I post about the experience since most people who have brought up in the issue on forums elsewhere on the glorious interwebz had various youthful indiscretions, but my youth was not interesting enough. Never arrested, let alone convicted for any crime, however minor, beyond traffic offenses...and none of those for at least a decade.

I hadn't bothered to get a permit here because residents do not need one. After I clear up whatever confusion caused this I will certainly get one.

The NRA says something like 5 percent of denials are overturned on appeal, which adds up to thousands per year and cautions that this may be only a small percentage of the real number of erroneous denials, speculating that many do not appeal or follow through with an appeal.

I would suggest obtaining a Personal Identification Number (PIN)... No more delays or denials!!!

Volunteer Appeal Files and UPINs from January 2015 are currently winding their way through the system. I will see the process through for whatever small vindication. I do want to get a UPIN, in addition to the state permit, in case I move or wish to buy a rifle retail in Montana etc.

Thanks to NICS, we don't have a right to buy a firearm, we have a privilege for which we must seek permission first. And now some think this should be required of private sales too.

I've never been in the shop when a UPIN denial or delay occurred, but I've heard anecdotal stories of such from both of my favorite gun dealers . . .

How long ago was this? Once upon a time you had to present domestic bills as proof of residence even with a Green Card. That requirement went away about 3-4 years ago IIRC.

I have bought firearms in just about every way you can read in the act, non-resident alien, Green Card holder and citizen. I was always delayed an hour or two when I was a non-resident alien because NHP had to check with immigration. No harm, no foul.

Of course, there was the NHP lady who didn't get that I was resident in NV but a non-resident in the US according to immigration law. I'm darned sure that the full procedure was not followed that evening, but I had all my paperwork straight so NMP.

Probably not so, it has got to be some other bureaucratic issue.

About a year ago. I could, of course, be wrong about the reason for the delay. It was just conjecture on my part with no solid evidence to back it up. Just the notion that some in government see long guns as inherently less dangerous than handguns due to the former's lack of concealability.

I've tried encouraging her to become a citizen, but for some reason she just isn't interested. She's lived here nearly thirty years now. Oh well, I guess we'll just keep renewing the old "green" card every 10 years.

Good luck. I've been waiting since early July 2015. I have absolutely no criminal record, but someone does with my name. It's ridiculous.

I am wondering if you might have just been at the right place (buying a firearm) at the wrong time??

I had thought that this might have been happening, but I just read that February 2016 was the third highest month on record for firearm purchases and Form 4473 approvals. If I am correct, last December was the highest, December 2012 after Sandy Hook was second, and February 2016 was #3. The approval request volume must have been really huge, again. Your request could have arrived when there was a spike in that volume.
 
I get delayed every time I purchase a Firearm.
I called the BATF and spoke to a very pleasant Woman and explained there is no reason for the delay, I have had a retired Police Officer run Me through their system and I come up clean.
She had Me run through their system and then told Me that another person with the same name as Me was a felon and that They keep getting Me mixed up with Him.( there are four people in My state with the same name as Me)I was told You can get a form from Your FFL and send it in to get a I.D. number to stop having the problem with Your purchase.
 
Do any of you put your SS no. on the form to avoid confusion?
