Previously Proceed but now delay?

Bought my SD9VE at Field and Stream, got an instant proceed from NICS, this was a month ago. Went to go get an AR, NICS comes back Delay. Ok, so if I'm ultimately denied by NICS for the AR, am I now in possession of my SD illegally according to the FBI?

Delays are common and the answer to your question is no.
 
The delay only pertains to the current 4473, fortunately.

They take each one on a case by case basis. Did you move recently?

Do you have a common name? Did 6 million people buy guns nationwide,

at the same time as you?
 
A delays does not mean you're getting denied. Not sure if other states do this, but in California it's up to the FFL to release or not to release a firearm after delay becomes "undetermined status".

Call Field and Stream and ask if they release firearms if the status becomes undetermined.
 
It was VERY BUSY this last Saturday, and there was a huge gun and knife show at a flea market near me, I'm in MI.
 
It depends on the time of day.If You buy early chances are You will be approved but if You go in the afternoon They are so backed up You get delayed.
 
My delay came back proceed so I'm picking up my AR today! Yay! Thanks everybody!

If it becomes a problem due to other person's with similar identifiers that may be questionable for buying a firearm, you can obtain a unique PIN that should eliminate delays.

Can anyone request such a PIN as a future problem eliminator or are such PINS given out if one has experienced routine trouble in legally buying firearms?

I'm one of those that always gives my SSN to avoid any potential issues. By the grace of God, I have never had an issue.

I'm not sure but sounds like contact ATF for further info/assistance. Here's what I found on ATF's site:
For buyers approved to have information maintained about them in the FBI NICS Voluntary Appeal File, NICS will provide you with a Unique Personal Identification Number, which the buyer should record in question 9 on the 4473 form.
 
I sat for 1 1/2 hours last month waiting for approval on a lower. 20 people got approved in the same time. No telling why except that I have purchased a few lowers this year. Supposedly it is the FDLE but who knows who is at the other end of the computer data stream. Joe
 
The online NICS system has been having a lot of problems after a recent update to their system. I do direct call in and haven't had any more delays than normal.
