He went over the line of self defense with the head shots, if nothing else. His butt is lawn.

On the other hand, two "pretty" criminals who thought they were above the law are removed from the gene pool early on.

Confusing story is confusing.

Where are the police reports of the previous break-ins and the increasingly violent nature of said break-ins? I believe it did say break-ins in his home - not just the surrounding area.
Was it the same two teens breaking in each time? Or was it some sort of local game to break into this guys house and mess with him that lots of teens in the area participated in and these two just picked the wrong day to do it?
What exactly were the teens looking for during the break0in that they went into the basement?
22 may not be very loud but unless it was subsonic with a suppressor - how did the second person not aware something bad was happening on the basement stairs to just casually stroll down them?

Since when is it a crime to be reading a book and having a snack in your own home?

On the other hand - it does sound to me like the guy went way over the line in defending himself from possible harm and ended the threat well before actually killing the perps.
There was a case not too long ago where the home owner was on the phone with 911 when his door was kicked in - if I recall he didn't fire until after the door got kicked in - but got into trouble when he told the operator that the bad guy was down and proceeded to "finish him off"
 
I saw this story today and always try to remember the media outlet reporting it has their own slant, like the no-gun types. I'll wait to see what comes out in court before forming an opinion.

Once the threat is neutralized, continuing force is viewed as excessive and subject to the full range of criminal and civil penalties.

I might add, that under no circumstances may you set a trap, either a shotgun with a trip cord or luring or baiting a specific individual to burglarize you through provocative, "inviting" comments.

However, if you are consistently burglarized each and every Friday night while you're at a social meeting, then, you decide to sit at home one Friday with your trusty scattergun at your side, I see nothing wrong with that provided you haven't baited whomever you think may be burglarizing you.

Also, I would avoid sharing all your home defense plans with whoever'll listen to you as you may hear those words again at trial.
 
I can't say that I'm sorry those kids are dead, but the shooter is a moron. He deserves what he gets from the jury. Sounds really unbalanced. I can't imagine how loud a mini-14 would be, in a basement. Hoo boy!

I like how the girl was described as a "role model". Yeah, a burglar role model. :rolleyes:
 
He obvious "thought" he was totally right but he never visited a gun chat site like this one or he would have known better. He hung himself many ways. Now morally, from our right wing view points, I can sympathies with him. I read several articles on the deal and read where HE had been burglared before. Also HE had guns stolen in those burglarys. Now what moron would wait 24 hours to report it? What moron would move the bodys? What moron would shoot them the second time with a second gun? What moron would tell the police she laughed at him and he shot her again?
If this guy is convicted it wont be for shooting in self defense or even shooting them. He will be convicted because he`s a moron.
It might be said he did a good community service though.
 
I won't comment on the "community service" aspect, as I doubt a community of 8,000 people is likely to see it that way.

But nearly all of us have been taught, or learned through simple common sense, that you shoot to end the threat, not specifically to "finish them off".
 
There will be a lot more of these none violent types getting killed breaking in once all the new criminals get released. The homeowner being in a state like Minnesota will be an uphill battle for him. Do they know which shot hit their head, the first one or the last one for sure?

Like a previous poster said, I would wait till more facts come out.

about the same shooting and it says they found prescription drugs from another house nearby and documents linked to Brady to a previous burglary of this man's home. I figure he will do a few years depending on the jury trial. I doubt the defense can keep all that information from coming out. The drug addiction problem sure causes a lot of young folks
to ruin or end their lives prematurely. I figure at a minimum he will be found guilty of 2nd degree murder.
 
This is a terrible shame. Three people's lives are ruined, not counting the extended families and friends, and for what?

This guy said he wanted them dead. Regardless of the physical evidence, he screwed himself with that statement. Further, he told them the actions he took. That is just further stupidity. Keep your mouth shut until you talk to a lawyer.

He's going to prison. The only question left is, for how long? I think first degree murder does not fit this case, but I'm not the prosecutor.
 
A year or two ago an Oklahoma pharmacist did something similar. After the pharmacist had shot a robber (justified) he later walked over to where the robber was lying on the floor and put another bullet in him. Pharmacist found guilty of first-degree murder.

However, to sit in his basement waiting is premeditation. That will work against him. To shoot the final fatal shot was stupid to do too.

Why didn't he call 911 when he thought something was going to happen? He seemed to know exactly when the break in was planned.

If the facts are basically as reported what he did wasn't stupid, is was criminal. He stopped defending himself when he incapacitated them, then became a murderer when he shot them again. Basic rule of self defense with a gun, you don't shoot to "kill" but stop the threat. When the threat no longer exists you don't get a pass to shoot them again.

Sitting in the basement isn't premeditation, it's smart. That is exactly what any self-defense school will tell you, barricade and wait for them to leave or the cops to show up. Shooting a threat as they come down the stairs is self-defense.

Now, if he baited them or enticed them to break into his house, that's premeditated.
