Today in Texas - open carry on the horizon

All I know is that here in Texas, my new CHL application has now passed the MANDATORY "within 60-days" law limit for "will grant" of my CHL.... So much for laws huh...

Now I don't have to worry if my gun peaks out on occasion while I conceal carry. Baby steps......

You haven't had to worry about that for quite awhile in Texas. Accidentally revealing your carry piece is not criminal in our state. Of course it might freak out a liberal or two.:D

It surprises me all of the time that my home state of Missouri has better gun laws than TX. Especially with the **** that runs this state. Glad to hear TX is moving in a similar direction.

We have had OC here in Alabama for about a year now. I've only seen a couple of people do so. The biggest advantage I see is that my concealed handgun doesn't have to be real well concealed. Our laws were pretty lax regarding printing, etc. before, but now that's a mute point.

Aloha,

Slight thread drift.

The Wife and I can't wait until we can Move to Texas.

She can't wait to have a BBQ with new friends so she can Finally wear her

BBQ guns. Course I'll have to get her new leather to match her guns.

All of my guns are plain with no "scratches".

All of my rigs are for IPSC and plain.

Guess I will have to get some of my 58s and 57s "defaced"

and suitable rigs commissioned.

Wherever we settle, We hope there will be forum members to invite.

Just to remind you, Hawaii Chiefs Do NOT issue any CCW permits.

There's an old Southern axiom that goes...

"The anticipation is greater than the event"

When Florida adopted it's statewide "Shall Issue" law in October of 1987 the liberal press predicted "Daily Gun Fights in the Streets!".

It did not happen here in Florida, and I doubt it'll happen in Texas with the passage of OC.

Not sure where you're getting that mandatory concept from, Mike. Can you point me to a rule somewhere? DPS says this:

DPS will make every effort to issue your license within 60 days of receiving the completed application packet. If the application is incomplete or requires additional information to complete the background check, you will be notified in writing.

"Every effort" does not equate to "mandatory".

If the Texas legislator would add a Open Carry fee (tax) to the bill....

She fly through at the speed of light and the Govenor's signature....why the ink wouldn't even be dry
before they started collecting application fee and fighting over who would be spending the newly found revenue. ;)

Although, it probably won't be the cash cow that the CHLs has been.

Both this State Senate Bill (SB17) and the State HOUSE Bill (HB910) are based on and expand the current CHL laws ("relating to the authority of a person who is licensed to carry a handgun"), so the State would be getting their Tax bucks. :)

I'm figuring the NEXT step might be the unlicensed carry of anyone who is legally eligible to purchase a handgun.

That will be much closer to a true open carry law than the one being considered. I have a funny feeling it won't happen, though. The progression I see is the state creating an OCP, an open carry permit. Similar to a CHL - the State makes money, and it can regulate to an extent who is permitted to openly carry. I can see that as the next step.

I just wish the house would hurry up and take action. Pass it, don't pass it, whichever. The suspense is killing me. I don't think I would feel comfortable open carrying in an urban setting, but I would not hesitate to do so while hiking/camping/fishing in a more rural setting. On the other hand I open carry within my home most of the time.

Strange that Texas law considers my vehicle to be an extension of my home and then requires me to conceal my handgun in the vehicle but not at home. I've always thought that one was weird.

I think of that, this way.
In my house, one would need to be invited in, or be illegally peeping through a window, to see a gun sitting on my coffee table (not that I do leave it on my coffee table). Nobody that's casually walking by my house can see my firearms. While at home, my firearms are not 'In Plain Sight'.

Not so, with a motor vehicle. Anyone could peer in through a window (unless it's severely tinted), invited or not, and see a firearm laying on someone's seat, dashboard, armrest, etc.

Now... If we all lived in Glass Houses, they probably would require us to keep our firearms concealed (along with most of our bodies :D) in the home as well.

Of course I'm a lit'l bias on this subject.....I like BBQs and BBQ pistols and fancy rigs.

But what gauds my rear is a feller can't open carry at his neighbors BBQ even if given permission by his neighbor....

From the Texas Penal Code;

PC §46.02. UNLAWFUL CARRYING WEAPONS
. (a) A person commits an offense if the person intentionally,
knowingly, or recklessly carries on or about his
or her person a handgun, illegal knife, or club if the person is not:

(1) on the person’s own premises or premises under the person’s control;

.

If I'm wrong....Show me the statute. :D

It's legal if you have a CHL and carry it concealed . . . unless the neighbor asks you not to.

Concealed yes with property owner's permission.....But, how about Open Carry at his BBQ,
can the property owner grant permission for open carry?

Ain't that the truth!

I couldn't believe all the whining and crying from gun owners at my Club when Guns in Bars was passed here. It was like they thought that everyone with a carry oermit were going out to get drunk and in get in bar room shootouts . Its been years since and we're doing just fine.

Gun freedoms, particularly carry, have been sweeping across the country for the past 30 years. Gun owners have done just fine despite all the prophets of doom and endless handwringing. Still, each time a new gun freedom comes up the whining and crying starts.
We're one of the largest nations in the world with over 300 million people. (That we know of) Yet, about 30,000 people are killed in automobiles every years. Considering long gun, hand guns and historic relics that can still fire we have to be the most gun responsible people in the world.
2nd Amendment! Its clear that we can KEEP and we can BEAR arms, period. States need to comply with our constitution.

No free man shall ever be debarred the use of arms.
